A man from Brooklyn, who dropped the tree branch he received compensation from the city for $3.85 million.
Jesus Santiago was returning home from the Public library in Manhattan, where he works, when suddenly he fell off the branch of the Norwegian maple. The incident occurred on Avenue H between 17th and 18th street in the Flatbush district.
52-year-old man received more than two dozen fractures and damage to internal organs 12 February 2009. Now he has to wear a special corset.
«Jesus hopes that the lawsuit will be a warning to the authorities of the city and forced them to follow the trees so this doesn’t happen again,» says lawyer men John Renzulli.
Santiago became one of the victims from the strong wind that swept through the city and took the lives of three people.
In April, the jury decided that the city is responsible for the incident in which a tree fell on Mr. Santiago. Renzulli says that the residents complained for years 311 crooked tree.
During the weeklong trial Renzulli proved to the jury that the city has no regulations for the proper inspection of the trees.
Back in 2006, one of the residents complained about the maple, however, the inspector decided that the tree is in satisfactory condition. In fact, in the trunk of the maple was hollow with a diameter of 30 inches. The tree was infected with a fungus, which further weakened him.
The lawyers were going to call a meeting for Monday to determine the amount of compensation, but the city has already solved this problem.
«It was an accident. Compensation is the best solution for both parties, — said the press-Secretary of the legal Department of the city.
