Federal rules prohibit Medicaid coverage of sexual services for all recipients, not just for sex offenders. However, an audit published by the state Comptroller Thomas DiNapoli showed that the official representatives of Medicaid approved such payments for drugs in the amount of $930 000.

47 of these Medicaid recipients have committed sexual offences.

«There are clear rules regarding expenses that Medicaid will cover, when it comes to medications for treatment of erectile dysfunction,» said DiNapoli. «You can’t pay for sex offenders who have committed terrible crimes. Confusion in byurokraticheskoi system of the program should not open a loophole for such drugs.»

Government officials in response to the criticism, insisting that, according to the rules of Medicaid, the drug for erectile dysfunction can be prescribed to treat other conditions such as prostate disease.

Auditors «ignored either the law or the facts that undermines the value of their opinions», — stated in the official written response of the Department. The authors of the test claim that, in many cases, the drugs were approved for those Medicaid recipients who do not have any prostate problems.
