Teen is transgender, who was unable to change the gender specified in the birth certificate, on Tuesday sued the state of new York, claiming that the discriminatory policy forces him to rely on a document which incorrectly reflects his personality.
In a lawsuit filed in Federal court in Albany, argues that the minority-transgender people should have the opportunity to correct birth certificate in new York, that is to say that underage people with documents in new York and some other States already can do. In 2014, the new York state expanded the number of those who can change the gender on the birth certificate, to enable those who have not passed a sex change operation.
Student of the school, who is now 14 years old, was born in Ithaca and at birth, was listed as a girl. Now the boy who in court documents is listed only by the initials M. H. W., says he is upset by his birth certificate.
The boy’s father Michael Sicinski told The Associated Press: «We just want our son the same recognition which is any other child that most children take for granted the fact that most parents take for granted.»
M. H. W., who now lives in Houston, Texas began to undergo hormone-replacement therapy in September, as stated in the lawsuit. The court in Texas approved a change of its name in October, and his mother Jennifer Wingard said that in official documents it can be specified as a boy.
The wingard fears that her son might encounter problems that will lead to the breakdown when he will apply for a provisional license due to specified gender in the documents. And so the boy had to be humiliated, she said, when he had to explain to the employees of the transportation security Administration why the name on his plane ticket does not coincide with the floors in the documents.
The lawsuit aims to change the rules of the state and the change of sex on the birth certificate M. H. W.
According to the report, Williams Institute, 2017, in the state of new York there are approximately 9750 Teens transgender aged 13 to 17 years.
