Prosecutors contend that the decision of trump was «due, at least partially, a discriminatory motive» against the Mexicans, who constitute the majority of «dreamers». This is indicated by his statements during the presidential campaign of 2016.

The attorneys General also argue that the government did not guarantee to DACA participants that their information from their questionnaires will not be used «to suppress immigrants, including the identification, detention, or deportation of non-citizens».

The representative from the state of new York, Eric Schneiderman led a case in the Eastern district of new York. He said that 42 000 inhabitants of new York are members of DACA, and the completion of the program will be «devastating» for them and will cause «enormous economic damage» to the state.

Other claims in the lawsuit based on the administrative procedure Law: it is alleged that the White house violated the legitimate process of policy change.

The legal experts consider filing a lawsuit against trump will probably face an uphill battle in court, because the President has very broad powers in relation to immigration policy.

To a claim is joined new York, Massachusetts, Washington, Connecticut, Delaware, Hawaii, Illinois, Iowa, new Mexico, North Carolina, Oregon, Pennsylvania, Rhode island, Vermont and Virginia.
