The diplomat during an interview for The Atlantic, explained that «the United States and Vietnam in 2008 signed a bilateral agreement on the expulsion, which shall establish procedures for the deportation of Vietnamese nationals arriving in the United States after July 12, 1995 and subject to final order of removal, said Trower. Although the procedures associated with this particular agreement, do not apply to Vietnamese citizens who arrived in the United States prior to July 12, 1995, this does not preclude an unambiguous exclusion from consideration of cases before 1995».

Thus, the deportation may touch upon those Vietnamese who arrived half a century ago, fleeing from the regime of Ho Chi Minh. In the state Department, however, explain that we are talking about persons who violate the laws of the United States, and convicted: «That’s 5,000 prisoners are immigrants from Vietnam with final expulsion orders».

The representative of the Department of homeland security Kathy Waldman told The Hill that «there are 7000 convicted criminals from Vietnam with final expulsion orders. The primary objective is the removal of criminal aliens to their home country».

In 2008, Vietnam and the US reached an agreement under which the Vietnamese who entered the United States prior to 1995 (when the two countries restored diplomatic relations) are not subject to deportation. However, Donald trump has repeatedly stated that he was not satisfied with this rule and spoke about the possible deportation together with the Vietnamese migrants from Cambodia.

In 2017, the White house had tried to start the deportation with the U.S. prisoners of the Vietnamese, but the process stopped due to the fact that Vietnam has refused to accept the deportees. Then to Hanoi left only 11 people.
