New York intends to ban to test employees for marijuana use

A member of the city Council of new York Jumaan Williams Wednesday, February 13, proposed a bill that would forbid companies to test new employees when hiring, as well as those working on probation for marijuana use.

Of course, for work with high risk the ban will not apply. Drug testing will remain in effect for law enforcement officers, when applying for work connected with management of vehicles or heavy machinery, with the employment of persons employed under contracts of the state or Federal government.

In States where legalized some form of cannabis use, the policy of drug testing when applying for work was a constant source of contradictions. According to doctors, the main psychoactive component of cannabis can stay in the body for quite a long time after its activity has ceased.

New York is moving quickly to legalize marijuana, the bill is intended to remedy the situation, while contradiction does not become an actual problem.

Of course, to come to work in a condition of narcotic intoxication is unacceptable, but the test for cannabis cannot accurately identify if the person is under its influence right now, or he had used drugs earlier. Urine tests for marijuana can often detect the presence of psychoactive substances, even if it took several weeks after cannabis use. So, a positive test result may not indicate the condition of the person and his ability to do his job.

«If you used «weed» in any way about a month ago, I don’t know how it can prevent you to do their job now,» Williams said to reporters of the NY Daily News.

The bill also States that drug tests after an accident in the workplace will be allowed.

City Council member Donovan Richards, who chairs the Council Committee on public safety, supports this idea, as it can help to reduce the number of prisoners in new York. Soon, Richards intends to propose a bill that would prohibit check people who are on probation after parole.
