New York is going to ban in court use of a gay panic as an excuse

Wednesday, June 19, the Assembly of new York voted to ban the use of gay and TRANS panic as a legal remedy in court. Such a law already exists in five other States.

The bill passed by the state Senate, will not allow criminals to justify the killing of homosexuals or transgender people, arguing that the affective state due to the fact that the victims showed sexual interest or molested them. Now the document is sent to Governor Andrew Cuomo, who has already said he will sign it.

«With the adoption of this measure, we are sending this poisonous strategy of legal protection to the dustbin of history,» said Cuomo, who made the bill a priority this year.

This decision was made amid growing number of crimes against LGBTQ. According to the National Coalition of Anti-Violence Programs (NCAVP), in 2017 52 murder of homosexuals and transgender people were on the hate, which is the highest ever recorded figure.

«This is an important victory for the LGBT community worldwide, and it is becoming increasingly important as we approach the 50th anniversary of the uprising in Stoneville, which initiated the modern movement for LGBTQ rights,» — said Cuomo in a statement.

5 States — California, Illinois, Rhode island, Nevada and Connecticut have already adopted this law. And although the use of gay panic in the court rarely leads to the justification, this strategy affects the imposition of a lesser penalty.

Just last year a Texas resident James Miller received 10 years probation for killing his neighbor Daniel Spencer. Miller claimed that twice struck the man in the back, because Spencer stuck to him with indecent proposals.
